By using Flashspeed ("the Service"), a product of Flash Solutions SIA (currently run under Clauma Marketing GmbH), you agree to be bound by these Terms of Service ("ToS"). If you do not agree to these terms, do not use the Service.

2. Description of Service

Flashspeed provides experimental methods to improve the page speed scores of websites, with a focus on Shopify stores. The Service is provided "as is" and is subject to change or discontinuation without notice.

3. Use of Service

a. You agree to use the Service at your own risk.b. You are responsible for the consequences of implementing changes recommended or made by the Service.c. You acknowledge that the experimental nature of the Service may result in unforeseen outcomes, including but not limited to changes in website performance, appearance, or functionality.

4. No Guarantee of Results

Flashspeed makes no guarantees regarding the effectiveness or the positive impact of its methods on your website's page speed scores or overall performance.

5. Availability of Service

The availability of Flashspeed is not guaranteed. The Service may be subject to interruptions, could be discontinued at any time, and may not always be available.

6. Limitation of Liability

a. Clauma Marketing GmbH is not liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use or the inability to use the Service.b. Clauma Marketing GmbH is not responsible for any loss of sales, revenue, or business as a result of using the Service.

7. Indemnity

You agree to indemnify and hold Clauma Marketing GmbH and its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the Service, your violation of the ToS, or your violation of any rights of another.

8. Modifications to Terms of Service

Clauma Marketing GmbH reserves the right to modify these ToS at any time without prior notice. Your continued use of Flashspeed following the posting of any changes to the ToS constitutes acceptance of those changes.

9. Governing Law

These ToS and the relationship between you and Clauma Marketing GmbH shall be governed by the laws of the jurisdiction where Clauma Marketing GmbH is registered, without regard to its conflict of law provisions.

10. Entire Agreement

These ToS constitute the entire agreement between you and Clauma Marketing GmbH and govern your use of Flashspeed, superseding any prior agreements between you and Clauma Marketing GmbH.
